Terms of Service

1. Acceptance of Terms
By downloading, installing, or using the BubDaze mobile application or website (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.
These Terms constitute a legally binding agreement between you and BubDaze Pty Ltd (ABN placeholder) (“BubDaze”, “we”, “us”, or “our”).
2. Description of Service
BubDaze is a baby tracking application that allows parents and caregivers to log and monitor their child's feeds, sleep, nappy changes, growth, milestones, and health events. The Service also provides data visualisation, AI-powered insights, and the ability to sync data between multiple caregivers.
3. Accounts
To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to:
- Provide accurate and complete information when creating your account
- Keep your account credentials secure
- Notify us immediately of any unauthorised use of your account
- Be at least 16 years of age to create an account
We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.
4. Subscriptions and Billing
BubDaze offers a free tier and paid subscription plans (Plus and Premium). Paid subscriptions are billed through the Apple App Store or Google Play Store.
- Prices are listed in Australian dollars (AUD) and include GST
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
- Free trials automatically convert to paid subscriptions unless cancelled during the trial period
- Refunds are handled by Apple or Google in accordance with their respective refund policies
- We may change subscription prices with at least 30 days notice
If you cancel a paid subscription, you retain access to paid features until the end of your current billing period. After that, your account reverts to the Free tier. Your data is preserved and accessible through Free tier features.
5. User Content
You retain ownership of all data and content you enter into the Service, including tracking data, notes, and photos (“User Content”). By using the Service, you grant us a limited licence to store, process, and display your User Content solely for the purpose of providing and improving the Service.
You are responsible for ensuring that your User Content does not:
- Violate any applicable law or regulation
- Infringe on the rights of any third party
- Contain malicious code or harmful content
6. Caregiver Access
The Service allows you to invite other caregivers to view and contribute to your child's tracking data. By inviting a caregiver, you grant them access to your child's data within the Service. You are responsible for managing caregiver access and can revoke access at any time from your account settings.
7. Medical Disclaimer
BubDaze is not a medical device and does not provide medical advice.
The Service is intended for informational and tracking purposes only. Growth charts, milestone information, AI-generated summaries, sleep predictions, and any other guidance provided by the Service are for general informational purposes and should not be used as a substitute for professional medical advice, diagnosis, or treatment.
Always consult your child's GP, paediatrician, child health nurse, or other qualified healthcare provider with any questions about your child's health or development. If you think your child may have a medical emergency, call 000 immediately.
8. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law, BubDaze's total liability to you for any claims arising from or related to the Service is limited to the amount you have paid us in the 12 months preceding the claim.
We are not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from reliance on information provided by the Service.
Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law that cannot be excluded or limited by contract.
9. Availability and Changes
We strive to keep the Service available at all times, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of significant changes.
We may update these Terms from time to time. We will notify you of material changes by email or through a notice in the app. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
10. Intellectual Property
The Service, including its design, code, content, logos, and trademarks, is owned by BubDaze and protected by Australian and international intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
